Terms of service
Last updated: September 23, 2026
These terms govern use of Construct Lifecycle (the “Service”), a construction lifecycle platform provided by Peak Technology Services, LLC (“we”, “us”), a Colorado limited liability company. By creating an account or using the Service you agree to these terms on behalf of yourself and the organization you represent (“Customer”, “you”).
1. The Service
Construct Lifecycle is a multi-tenant, web-based application for managing construction projects from opportunity through closeout. Features available to you depend on the plan you subscribe to, as described on our plans page. We may update the Service, add or remove features, and change plan contents; material reductions to a plan you have paid for will be communicated in advance and you may cancel for a pro-rated refund if you do not accept them.
2. Accounts and access
- You must provide accurate account information and keep your login credentials secure. You are responsible for all activity under your account and the accounts of users you invite.
- You must be at least 18 years old and authorized to bind the Customer to these terms.
- Each plan limits the number of internal users and active projects. Additional users may be added as described on the plans page.
3. Subscriptions, fees and payment
- Basic and Growth plans are billed monthly or annually in advance by card through our payment processor, Stripe. Enterprise plans are billed under a separate written agreement.
- Prices are in US dollars and exclude applicable sales tax, which we collect where we are required to.
- Subscriptions renew automatically at the end of each billing period unless canceled. Cancellation and refunds are governed by our refund and cancellation policy.
- If a payment fails we will notify you and retry. If payment is not received within 14 days we may suspend access until the balance is paid.
- We may change prices with at least 30 days' notice; changes apply from your next renewal.
4. Your data
- You own the data you and your users enter into the Service (“Customer Data”). You grant us a license to host, process, back up and display Customer Data solely to provide and support the Service.
- You are responsible for the accuracy and legality of Customer Data and for having the rights needed to upload it, including data about your customers, vendors and employees.
- Customer Data is kept separate from other customers' data. Where the Service offers sharing between organizations, data is shared only when you explicitly grant it.
- You may request an export of your Customer Data at any time while your subscription is active and for 30 days after it ends; we will provide it in a commonly used, machine-readable format. After that 30-day period we delete Customer Data from active systems; backups are purged on their normal rotation.
- How we handle personal information is described in our privacy policy.
5. Acceptable use
You agree not to: use the Service for unlawful purposes; upload malicious code; attempt to gain unauthorized access to the Service or other customers' data; resell or sublicense the Service without a written agreement with us; reverse-engineer the Service except where the law permits; or use the Service to build a competing product.
6. Third-party services
The Service integrates with third-party products (for example accounting, e-signature, mail and estimating tools) that you choose to connect. Your use of those products is governed by their own terms. We are not responsible for their availability or for data they hold, and disconnecting an integration does not delete data already synced to the third party.
7. Availability and support
We aim to keep the Service available continuously, but we do not guarantee uninterrupted service. Planned maintenance will be notified in advance where practical. Support is provided by email at support@constructlifecycle.com during the hours published on our website; Enterprise agreements may include additional support commitments.
8. Intellectual property
The Service, its software, design and documentation are owned by Peak Technology Services, LLC and its licensors. Construct Lifecycle and Construct LC are our trademarks. These terms do not transfer any ownership to you. Feedback you provide may be used by us without obligation.
9. Confidentiality
Each party will keep the other's non-public information confidential and use it only to perform under these terms, except where disclosure is required by law.
10. Warranties and disclaimer
We warrant that the Service will perform materially as described in our documentation. If it does not, notify us and we will use reasonable efforts to correct the problem; if we cannot do so within 30 days, you may terminate the affected subscription and receive a refund of prepaid fees for the unused portion of the term. That is your sole remedy for breach of this warranty. Except for that warranty, the Service is provided “as is” and “as available”, and we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Construct Lifecycle is a business tool; you remain responsible for decisions made using it, including bids, contracts, purchase orders and financial records.
11. Limitation of liability
To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits or revenue. Our total liability arising out of these terms is limited to the fees you paid us in the 12 months before the claim. These limits do not apply to a party's breach of confidentiality, infringement of the other's intellectual property, or liabilities that cannot be limited by law.
12. Indemnity
You will defend and indemnify us against claims arising from Customer Data or your use of the Service in breach of these terms. We will defend and indemnify you against claims that the Service, used as permitted, infringes a third party's intellectual property.
13. Termination
You may cancel your subscription at any time from your account settings. We may suspend or terminate your access for material breach of these terms that is not cured within 14 days of notice, or immediately for conduct that threatens the security or integrity of the Service. Sections 3 (for amounts owed), 4, 8 to 13, 15 and 16 survive termination.
14. Changes to these terms
We may update these terms. We will post the new version here and, for material changes, notify account owners by email at least 30 days before they take effect. Continued use after that date is acceptance of the new terms.
15. Governing law and disputes
These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. The parties will attempt to resolve any dispute informally first. Any dispute not resolved within 60 days will be brought exclusively in the state or federal courts located in Colorado, and each party consents to their jurisdiction and venue.
16. General
- Notices. We send notices to the email address of your account owner. You send notices to us at support@constructlifecycle.com. Notices are effective when sent, unless the sender receives a delivery failure.
- Assignment. Neither party may assign these terms without the other's consent, except to a successor in a merger, acquisition or sale of substantially all of the relevant business, with notice to the other party.
- Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, such as outages of internet or hosting providers, natural disasters or acts of government. This does not excuse payment obligations.
- Entire agreement. These terms, together with the policies they reference and any order or Enterprise agreement, are the entire agreement between the parties about the Service. If an Enterprise agreement conflicts with these terms, the Enterprise agreement controls.
- Severability and waiver. If any provision is found unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver of it.
- Independent parties. The parties are independent contractors; these terms create no partnership, agency or employment relationship.
